2. Products, Pricing, and Orders

2.1. Product Accuracy: We make every effort to display the colors, features, and specifications of our products as accurately as possible. However, the actual colors you see will depend on your monitor, and we cannot guarantee that your device's display of any color will be accurate. All sizes and measurements are approximate.

2.2. Pricing Errors: While we strive for accuracy, in the event a product is listed at an incorrect price due to a typographical error or error in pricing information, we shall have the right to refuse or cancel any orders placed for the product listed at the incorrect price, whether or not the order has been confirmed and your payment processed.

2.3. International Pricing (Currency): Prices for international customers are converted from Indian Rupees (₹) to your local currency at the exchange rate prevailing at the time of the transaction. The final charged amount may vary slightly due to your bank or payment processor's foreign exchange fees.

2.4. Order Acceptance: Your receipt of an electronic or other form of order confirmation does not signify our final acceptance of your order. We reserve the right at any time after receiving your order to accept or decline your order for any reason, including product unavailability, inaccurate pricing, or suspicion of fraud.

 

3. Payment Terms and Taxes

3.1. Payment Methods: We accept major credit/debit cards, net banking, and other payment methods as displayed on our checkout page. Payment is processed immediately upon placing your order.

3.2. Domestic Taxes (India): For orders shipped within India, all prices are inclusive of Goods and Services Tax (GST) as applicable under Indian tax laws.

3.3. International Duties, Taxes, and Fees:

• For orders shipped outside India, the prices displayed on the website DO NOT include any import duties, customs fees, VAT, or other local taxes levied by the destination country.

• The customer is solely responsible for paying any and all customs duties, import taxes, or brokerage fees upon the package's arrival in the destination country.

• Vintanaro will not refund or compensate the customer for packages refused due to the failure to pay these charges.

 

4. Shipping, Delivery, and Risk of Loss

4.1. Shipping Policy Integration: These Terms incorporate by reference the full Vintanaro Shipping Policy, which governs shipping methods, estimated timelines, and costs.

4.2. Risk of Loss: All products purchased from Vintanaro are made pursuant to a shipment contract. This means that the risk of loss and title for such items passes to you upon our delivery to the carrier. We are not responsible for packages lost, stolen, or damaged after the carrier confirms delivery.

 

5. Returns, Refunds, and Cancellations

5.1. Policy Integration: Our detailed policy on returns, refunds, and exchanges is set forth in our separate Return Policy, which forms an integral part of these Terms.

5.2. Right to Cancel/Refuse: We reserve the right to refuse or cancel an order for any reason, including limitations on quantities available for purchase, inaccuracies in product or pricing information, or problems identified by our credit and fraud avoidance department.

7. Limitation of Liability and Indemnification

Limitation of Liability: TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, VINTANARO, ITS DIRECTORS, EMPLOYEES, AFFILIATES, OR AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO, LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM (I) YOUR ACCESS TO OR USE OF OR INABILITY TO ACCESS OR USE THE SERVICE; (II) ANY CONDUCT OR CONTENT OF ANY THIRD PARTY ON THE SERVICE; OR (III) ANY UNAUTHORIZED ACCESS, USE, OR ALTERATION OF YOUR TRANSMISSIONS OR CONTENT, WHETHER BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE) OR ANY OTHER LEGAL THEORY.

Indemnification: You agree to defend, indemnify, and hold harmless Vintanaro and its licensee and licensors, and their employees, contractors, agents, officers, and directors, from and against any and all claims, damages, obligations, losses, liabilities, costs, or debt, and expenses (including but not limited to attorney's fees), resulting from or arising out of (a) your use and access of the Service, or (b) a breach of these Terms.

 

8. Governing Law and Dispute Resolution

8.1. Governing Law: These Terms shall be governed and construed in accordance with the laws of India, without regard to its conflict of law provisions.

8.2. Exclusive Jurisdiction: Any dispute or claim arising out of or in connection with these Terms, or the breach, termination, or invalidity thereof, shall be subject to the exclusive jurisdiction of the courts located in KOLKATA in India.
